Arbitration Leaves No Record of Injustice

Do you know why Corporate America loves arbitration and favors it in Consumer transactions?Because once the decision is made, there is no history of the case.An arbitrator can decide the facts wrong, the law wrong and then protect Corporate America with his or her decision and there will be no record whatsoever.

In a case filed in the Court system, even if it is never appealed, there is a record that it was filed and sometimes, you can glean amazing facts and circumstances from the court record.

In arbitration, once the case is removed from the Court System, that is it.It is all over and there is nothing that can be done about it.There is caselaw that says if an arbitrator rules completely contrary to law and fact, the Court can remand the case back to arbitration and overturn the award, but it is so rare, you have a better chance of winning the lottery.

So in the situation where an arbitrator ruins a family and makes an award for Corporate America, there is no public outrage because the pubic never hears about it.
