When Real Estate Disclosures NOT Required


Real Estate Disclosures are required under the Texas Property Code, Section 5.008.However, there are some exceptions.Namely, if the seller has no prior knowledge of the conditions and features of the house.This can happen when an investor purchases and resells the house or when an heir inherits a property they have never lived in. 

Even though the house may not have been lived in by them, the seller could still have knowledge of conditions and features particularly when the house is renovated.Repairs and remodeling will put the seller on notice of the problems encountered during the reconstruction phase.Contact the neighbors and ask if repairs have occurred recently.

Look for signs of fresh paint and caulking.If you find fresh caulking in areas of older damage, you may have found the smoking gun.Keep your eyes open.
