JUDGE RANDY WILSON KNOWS BETTER THAN JURY!!!!
(TOO BAD HE DOESN'T KNOW THE LAW.)
In January, a Harris County jury found Cartus Financial guilty of fraud and knowing violaitions of the Texas Deceptive Trade Practices Act. The jury found that Cartus, the world's largest relocation company, was responsible for failing to disclose all of the termite damage, wood rot and water penetration that occurred when Cartus' contractor repaired the house.
Judge Randy Wilson, a Republican, of the 157th District Court, however, overturned the jury's verdict and saved the world's largest relocation company from having to pay any monies the jury awarded. Judge Randy Wilson, Republican, decided against the homeowners mostly because he failed to follow the law in Texas that a seller can not include and rely on an "AS IS" clause and then also provide assurances or representations of the house's condition as Cartus did in this case.
The decision by Judge Randy Wilson, a Republican, to overturn the jury's verdict will be appealed.
