To understand why the TRCC should be executed and put to death, you have to understand their purpose. There is the stated purpose - to help homeowners and builders manage their warranty agreements. But that is not the real purpose.
The real purpose of the TRCC is to discourage and even eliminate consumer complaints about builders. This is done chiefly by requiring the consumers to endure a 9-12 month process of "independent" inspection. This prolonged bureacratic process makes no provision for attorneys fees and therefore, the system automatically favors the builders. The average homeowner has no idea how to use the system, much less succeed in it. On the other hand, the builders are ramped up and ready to go with their teams of lawyers, highly experienced and versed in the structure and operations of the TRCC.
The net effect is that most homeowners have no legal representation through the TRCC process while the builders manipulate and game the system.
I will say it again. If an inspector is supposed to be unbiased and provide an objective inspection report, why is the builder allowed to be present with his stable of experts to lobby the inspector during his inspection? Why? Because it is meant to tip the scales in favor of the builder.
